New Driver Offences

Support and advice tailored to newly qualified drivers and offence charges.

Upon passing a driving test new drivers are subject to a probationary term of two years.

If during this probationary period you accumulate six or more points the DVLA will automatically revoke your licence.

This differs from a driving ban. You will have to reapply for a provisional licence and then retake your driving test. In effect, you have to start over again! This can be a costly exercise with potentially additional driving lessons being required to be confident in passing your written and practical tests.

As a new driver you are unable to present an ‘exceptional hardship’ argument although you can appeal the conviction that led to the loss of your licence.

With our Motor Law service you have access to a specialist team of solicitors who are experienced in representing new drivers.

Our team carefully examine the circumstances surrounding the revocation of your licence and will advise on the most appropriate steps forward to achieve the best possible outcome for you.

Even in circumstances where there is no defence and the offence would usually lead to you reaching six penalty points, there are strategies that we can employ to avoid this. Often this will result in a driving ban rather than points, which would mean that you wouldn’t be required to retake your test and start over again.

As a new driver the prospect of losing your licence can be a daunting experience. By seeking legal advice of our Motor Law team from the outset you can help to ensure that any potential implications are effectively managed. Having access to expert advice can bring peace of mind at a time when you need it most.
