Applications for legal aid funding still remain for the following areas of family law:
- Care and supervision proceedings involving Social Services. A parent in such proceedings is automatically and immediately entitled to legal aid irrespective of their financial means.
- Matters where you have been a victim of domestic abuse.
- Other exceptional cases.
- Mediation and advice following mediation.
- Private disputes between parents regarding arrangements for children if there is evidence that the other person has been assessed as presenting a risk to children.
It is important to remember that for matters excluding care and supervision proceedings, it is still necessary to qualify financially and evidence would need to be produced as to both income and capital assets as part of the legal aid assessment process.
